The winners and losers in Wednesday's ruling on the permanent euro bailout fund by Germany's highest court may appear clear cut, but the decision is more complicated than it seems. Before the European Stability Mechanism can be ratified, the German government must answer complicated legal questions.

Some formal rules are not considerated : the Vienna Convention on the Law of Treaties 1969, and the definiton and recalling of concerned legal persons. The degree of
obligation is , according to ESM reference art 126 Treaty EU the recommendation , being not a binding legal act. One of the last commands to the deficient member could be to open an account with credit values in order to pay the debts, appliance of banknote printing is not mentioned as forbidden means, and is permitted to NCBs by binding ECB Decision OJ 2011.nr35. Forms of Treaties and legal persons should be distinguished in EU Treaty to reach valid accord.
